These Terms of Use ("Terms") govern your access to and use of the EndoGynePRO online educational platform ("Platform"), operated by Dr. Sanket Pisat / EndoGynePRO.

By creating an account, purchasing a subscription, or accessing any content on this Platform, you acknowledge that you have read, understood, and agree to be legally bound by these Terms.

1. Eligibility

The Platform is intended exclusively for:

• Registered Medical Practitioners
• Obstetricians & Gynecologists
• Gynecological Endoscopic Surgeons
• Residents, Fellows and Postgraduate Trainees
• Healthcare professionals involved in women's health

By registering, you represent that:

• the information provided is true and accurate;
• you are legally permitted to access medical educational material in your country;
• you are responsible for maintaining the confidentiality of your account.

The Platform reserves the right to verify professional credentials and refuse or terminate access at its sole discretion.

2. Acceptance of Terms

Your use of EndoGynePRO constitutes acceptance of these Terms and all associated policies, including:

• Refund Policy
• Copyright Policy
• Community Guidelines
• Cookie Policy

If you do not agree, you must discontinue use immediately.

3. Educational Purpose Only

All content available on EndoGynePRO is intended solely for professional medical education.

The videos, lectures, surgical demonstrations, operative recordings, illustrations and written material are designed to enhance surgical knowledge and should not be considered:

• medical advice
• treatment recommendations
• clinical guidelines
• standards of care
• certification of competence

Completion of any course does not certify proficiency in any surgical procedure. Users remain solely responsible for exercising independent clinical judgment.

4. Medical Disclaimer

The procedures demonstrated represent the operating surgeon's preferred techniques under specific clinical circumstances.

Individual patients differ significantly in:

• anatomy
• pathology
• comorbidities
• surgical risks
• available equipment
• institutional protocols

Accordingly,

• no guarantee of surgical outcome is made;
• techniques should not be replicated without appropriate training;
• users must comply with local laws, hospital policies and professional guidelines.

5. Surgical Competency

Watching surgical videos does not constitute formal surgical training.

Users acknowledge that:

• operative competence requires supervised clinical training;
• credentialing is determined by the user's institution;
• the Platform does not issue operative privileges.

6. Patient Privacy

Many videos contain actual operative footage obtained with appropriate patient authorization in accordance with applicable ethical standards.

Users agree that they shall never:

• attempt to identify patients;
• reproduce patient images;
• use screenshots in publications without written permission;
• distribute videos outside the Platform.

7. Intellectual Property

All Platform content including but not limited to:

• surgical videos
• edited videos
• masterclasses
• conference lectures
• webinars
• illustrations
• animations
• graphics
• text
• presentations
• voice recordings
• course structure

are protected under applicable copyright and intellectual property laws.

Ownership remains exclusively with EndoGynePRO and/or respective licensors.

No ownership rights are transferred to subscribers.

8. Limited License

Subscribers receive a limited, non-exclusive, non-transferable, revocable license to stream educational content solely through the official Platform during an active subscription.

No other rights are granted.

9. Anti-Piracy & Content Protection

EndoGynePRO employs advanced anti-piracy technologies including:

• Digital Rights Management (DRM)
• encrypted video streaming
• forensic watermarking
• dynamic user watermarking
• IP monitoring
• device fingerprinting
• access logs

Users expressly agree that they shall not:

• screen record
• photograph the screen
• download videos
• extract audio
• bypass DRM
• use browser extensions to capture content
• upload content elsewhere
• share login credentials
• livestream the content
• distribute copies to third parties

Attempting any of the above constitutes a material breach of these Terms.

10. Watermarking

Every video stream may contain invisible and/or visible forensic identifiers including but not limited to:

• account information
• IP address
• timestamp
• device identifier
• session identifier

These identifiers may be used during piracy investigations.

11. Account Security

Users are responsible for:

• maintaining password confidentiality;
• restricting access to their account;
• all activity occurring under their login.

Account sharing is prohibited.

Simultaneous logins from multiple locations or suspicious activity may result in temporary suspension pending investigation.

12. Subscription Terms

Subscriptions provide access only during the paid subscription period.

Unless expressly stated:

• subscriptions are non-transferable;
• unused subscription periods are not refundable;
• content availability may change over time;
• individual videos may be added or removed.

EndoGynePRO reserves the right to modify subscription pricing for future billing cycles.

13. Refund Policy

Except where required by applicable law, subscription fees are non-refundable.

Refunds shall not be issued due to any of the below reasons (including, but not limited to):

• inability to complete a course;
• change of personal preference;
• lack of time;
• internet issues on the user's side;
• device incompatibility;
• suspension resulting from Terms violations.

14. Platform Availability

While reasonable efforts are made to ensure uninterrupted service, the Platform does not guarantee:

• uninterrupted availability;
• error-free operation;
• continuous access;
• compatibility with every device.

Maintenance, upgrades or technical failures may temporarily interrupt access.

15. Third-Party Services

The Platform may utilize third-party services including:

• payment gateways;
• cloud hosting;
• content delivery networks;
• analytics providers;
• authentication services.

EndoGynePRO is not responsible for interruptions arising from such third-party providers.

16. User Conduct

Users shall not:

• upload unlawful material;
• harass other members;
• post misleading medical information;
• impersonate another individual;
• interfere with Platform security;
• attempt unauthorized access;
• reverse engineer software;
• introduce malware.

17. Continuing Medical Education

Unless specifically stated, participation does not provide:

• CME credits
• university certification
• fellowship qualification
• board certification
• surgical accreditation

18. Changes to Educational Content

Medical science evolves continuously.

EndoGynePRO reserves the right to:

• update content;
• remove obsolete techniques;
• modify lectures;
• replace videos;
• revise educational recommendations.

Older videos may demonstrate practices that are no longer considered current standards of care.

19. No Professional Relationship

Use of this Platform does not establish:

• doctor-patient relationship;
• physician supervision;
• mentorship agreement;
• employment relationship;
• institutional affiliation.

20. Limitation of Liability

To the maximum extent permitted by law, EndoGynePRO, its owners, employees, faculty, guest speakers, and affiliates shall not be liable for any direct, indirect, incidental, special, punitive, or consequential damages arising from:

• use of the Platform;
• inability to access content;
• reliance on educational material;
• surgical complications;
• malpractice claims;
• data loss;
• business interruption.

21. Indemnification

Users agree to indemnify and hold harmless EndoGynePRO and its faculty against any claims, damages, liabilities, legal costs or expenses arising from:

• misuse of the Platform;
• violation of these Terms;
• infringement of intellectual property;
• unlawful redistribution of content.

22. Suspension and Termination

EndoGynePRO may suspend or terminate any account without prior notice for:

• piracy;
• account sharing;
• abusive conduct;
• violation of these Terms;
• fraudulent activity;
• misuse of educational material.

Termination does not entitle the user to any refund.

23. Governing Law

These Terms shall be governed by the laws of India.

Any disputes shall be subject exclusively to the jurisdiction of the competent courts in Mumbai, Maharashtra, India, unless otherwise required by applicable law.

24. Force Majeure

EndoGynePRO shall not be liable for failure or delay in performance resulting from events beyond its reasonable control, including natural disasters, epidemics, governmental actions, internet outages, cyberattacks, labor disputes, or failures of third-party service providers.

25. Modifications to the Terms

EndoGynePRO reserves the right to revise these Terms at any time.

Material changes will be communicated through the Platform or by email.

Continued use after such changes constitutes acceptance of the revised Terms.

AI Restriction Clause

Users are prohibited from uploading videos, screenshots, transcripts, or course materials to AI tools (including ChatGPT, Gemini, Claude, Grok, etc.) for analysis, summarization, or model training without written permission

No Secondary Teaching License

A subscription permits only personal learning. Users may not incorporate videos, slides, screenshots, transcripts, or recordings into their own paid courses, workshops, webinars, institutional teaching, or commercial educational materials without prior written consent.

Guest Lecturer Copyright

Conference lectures and masterclasses delivered by invited faculty remain subject to copyright and any additional restrictions imposed by those speakers. Recording, redistribution, or reuse is prohibited.

Research and Publication Restriction

Users require written permission before reproducing images, figures, operative screenshots, or video excerpts in journal articles, presentations, books, conference posters, social media, or other publications, even if educational in nature.

Sanctions and Export Compliance

Users are responsible for ensuring that access to the Platform complies with the laws and regulations applicable in their jurisdiction, including any sanctions or export-control restrictions.
